Portugal é um dos poucos países europeus que não pune criminalmente os imigrantes em situação irregular, constata um relatório publicado esta quinta-feira, que analisa a compatibilidade das medidas anti-imigração com os direitos fundamentais. Segundo a Agência da União Europeia para os Direitos Fundamentais, Malta e Portugal são os únicos países cuja legislação não prevê nem pena de prisão nem coimas para os imigrantes que entrem ilegalmente no seu território ou que não possuam documentação válida, embora acionem imediatamente mecanismos para a deportação. Nos outros países, há atitudes diversas: Espanha, por exemplo, não pune criminalmente a entrada ilegal de imigrantes, mas aplica multas aos indocumentados, ao inverso de França, que castiga criminalmente a entrada ilegal mas não os imigrantes encontrados sem documentos válidos. Em Itália, um imigrante ilegal pode ser multado até 10 mil euros e em outros países a pena de prisão pode variar entre um mês e cinco anos de prisão para além da deportação, refere o relatório. Apoiando-se em decisões do Tribunal de Justiça da União Europeia, a agência europeia defende o fim das penas de prisão, pois considera que deve prevalecer a legislação que determina o regresso, voluntário ou forçado, do imigrante ilegal ao país de origem. "O uso de sanções criminais e prisão para combater a imigração ilegal prejudica não só as pessoas em causa, mas também dá uma imagem negativa de como a sociedade como um todo os considera", refere o relatório.

José Mourinho admitiu este fim de semana, quando comentava as convocatórias das seleções para os jogos do meio da semana, que apenas admite ter jogadores da nacionalidade em causa caso se torne selecionador nacional. Mourinho falou concretamente a seleção portuguesa, garantindo que nunca chamaria estrangeiros se fosse o comandante técnico.

"Se um dia for selecionador nacional, apenas vou levar jogadores do país, isso de certeza. E, se não tiverem nascido no país, terão de ter familiares com grande ligação ao país. Nunca levarei um jogador apenas por ter passaporte do país, por acreditar que torne a equipa mais forte. Para mim, uma seleção nacional representa imenso, é isso que sucede com a minha", começou por dizer, falando depois do caso português.

UK launches £2m project in Greece to assist repatriation of migrants

The British government has launched a £2m project in Greece to assist the repatriation of migrants to countries in Africa, Asia and the Middle East, as it emerged that 18,500 had voluntarily left since the onset of the Greek debt crisis.

The British embassy unveiled the programme in Athens on Wednesday as part of an effort to stem the flow of immigrants to the UK.

"Our assessment is that the UK remains a primary final destination country for many of the irregular migrants in Greece," said the British ambassador, John Kittmer.

"British funding for this programme is ultimately about reducing illegal migration to the UK. That is why we are co-operating with the Greek government as it faces the continuing challenge of illegal migration."

With one of the longest coastlines in Europe and some of its most porous borders, Greece has long been seen as the easiest backdoor entrance to the EU. Migrants from Asia, Africa and the Middle East, the vast majority smuggled from neighbouring Turkey, view it as a stepping stone to a better life. In recent years refugees fleeing Syria's civil war have swelled the numbers arriving.

The influx has increased pressure on Greece's cash-strapped government to step up patrols along Europe's eastern border. Under the watchful eye of the EU, and that of the country's neo-Nazi Golden Dawn party, the administration of prime minister Antonis Samaras has cracked down on illegal migrants, often employing controversial measures to round them up and clear them off the streets.

The construction of a six-mile barbed wire security fence along the Greek-Turkish land border has also dramatically reduced the flow, but smugglers are increasingly ferrying their human cargo to Greece's outlying eastern isles in the Aegean Sea.

Home Office officials said Turkey's liberal visa regime and the expansion in Asia and Africa of Turkish Airlines, the country's national carrier, had helped facilitate the influx.

Many of the 1,500 migrants the programme seeks to assist would otherwise end up in the UK, they said.

With human rights groups reporting an alarming rise in the number of deaths in the Aegean, and the Greek coastguard accused of forcing boats back out to sea, officials say it is also imperative that migrants are made aware of such perils before they set out.

"We are also thinking of establishing offices in countries like Pakistan to convince [would-be migrants] that when they make such journeys they will be at the mercy of God, that traffickers who bring them to Europe do not have their best interests at heart," said Greece's public order minister, Nikos Dendias, who was also present at the project's launch.

Implemented by the International Organisation for Migration (IOM), the programme will see immigrants being repatriated to Pakistan, Afghanistan, Iraq, Iran, Bangladesh, Morocco, Egypt, India, Nigeria and Sudan over the next two years. Unaccompanied minors, mostly from Afghanistan, single-parent families and migrants with medical needs will be among the returnees. The project will also assist the voluntary return of around 30 victims of human trafficking, mostly EU citizens from eastern and central Europe.

With Greece experiencing its worst recession since the second world war, more migrants have voluntarily elected to leave the country than at any other time and any other nation in the EU. "Around 18,500 returns were made through different programmes over the last three years," said Laura Thompson, the IOM's deputy director general. "Partly because of the crisis and lack of job opportunities, but also because migrants have realised that with all the extra measures … there is no possibility of them getting to another European country."

EU migrants face new barrier to accessing UK state benefits

European migrants will have to have been earning £150 a week for three months before they can access most UK state benefits, the work and pensions secretary has announced.

Iain Duncan Smith has decided that from March all EU migrants will have to reach this threshold in order to qualify for "worker" status.

David Cameron has been drip-feeding a series of measures to reduce the attractiveness of the UK for EU migrants unlikely to find full-time work here.

People who have been classed as workers under the Department for Work & Pensions rules will then be able to claim child benefit and child tax credit, jobseeker's allowance if they lose their employment, and housing benefit.

But the DWP interpretation of what constitutes a worker is likely to be controversial since it admits the EU definition is unclear.

The earnings threshold will be set at the level at which people start paying national insurance: £149 a week in 2013-14, and £153 a week in 2014-15.

The £150 threshold is equivalent to working 24 hours a week at the national minimum wage.

Anyone with earnings below that threshold will face a fuller assessment of whether their work was "genuine and effective", with the possibility of being denied worker status.

Where a decision is made that an EU migrant should not be considered a worker, then they would be classed either as a jobseeker or economically inactive, which would restrict their access to the welfare system.

The former will have to wait three months before getting income-based jobseeker's allowance (JSA) and, after the introduction of new rules on 1 April, will be ineligible for housing benefit.

Those deemed not economically active would need earnings above income support levels and comprehensive sickness insurance to be eligible to claim child benefit or child tax credit.

The DWP claims that under EU case law, work must be genuine and effective, and not on so small a scale to as to be "marginal and ancillary". The department says there is not clear definition of what ancillary means in this case.

Duncan Smith said: "As part of the government's long-term economic plan we have taken action to make sure our economy delivers for people who want to work hard, play by the rules, and contribute to this country.

"These reforms will ensure we have a fair system – one which provides support for genuine workers and jobseekers, but does not allow people to come to our country and take advantage of our benefits system.

"The British public are rightly concerned that migrants should contribute to this country, and not be drawn here by the attractiveness of our benefits system."

The government has already announced that after three months, migrants will also have to take a stronger, habitual residence test if they want to claim income-based JSA.

If they pass that test, jobseekers from the rest of the European Economic Area will then only be able to get JSA for six months. After that period, only those who have a job offer or compelling evidence that they have a genuine chance of finding work will be able to continue claiming.

Danos elevados em assalto a multibanco numa bomba de gasolina no Seixal
Explosão provocou muitos danos no edifício


Um assalto a uma caixa multibanco numa bomba de gasolina nos Foros da Amora, no Seixal, causou, este sábado de madrugada, a destruição parcial do edifício e danos em vivendas que ficam nas imediações do local, disse fonte policial.

"Durante a madrugada ocorreu um assalto a uma bomba de gasolina que tinha um multibanco. Terá sido usado gás para o efeito", disse a mesma fonte à agência Lusa, acrescentando que "a explosão provocou muitos danos no edifício, que pode mesmo ter de ser demolido, e danos em vivendas nas imediações, que ficaram com os vidros partidos.

A fonte da polícia disse que o assalto ocorreu durante a madrugada nos Foros da Amora, no concelho do Seixal, e existem testemunhas que referem terem visto quatro pessoas a fugir do local numa viatura.

A polícia adiantou que não existem ainda informações se os assaltantes levaram o dinheiro que estava na caixa multibanco ou não.

No local estiveram também elementos da Polícia Judiciária a recolher indícios do crime.

Fonte do Comando Distrital de Operações de Socorro (CDOS) de Setúbal disse à Lusa que a ocorrência não causou qualquer ferido.

Novo ACIDI quer imigrantes qualificados e reter jovens


O Governo quer que o Alto Comissariado para a Imigração e Diálogo Intercultural (ACIDI) aposte na atração de imigrantes qualificados para o país que contribuam para reter os portugueses, anunciou à Lusa o secretário de Estado Pedro Lomba.
O diploma que define a reforma do ACIDI encontra-se em processo legislativo, que o secretário de Estado Adjunto do ministro Adjunto e do Desenvolvimento Regional estima que esteja concluído no início do próximo ano.
"Queremos um novo ACIDI, dotá-lo de novas competências adequadas aos novos perfis migratórios do país, como os estudantes internacionais, os residentes de longa duração e os reformados", disse o governante, que falava à Lusa a propósito do Dia Internacional do Migrante, que se assinala na próxima quarta-feira.
Por outro lado, este organismo deverá ainda ver aumentadas as suas competências na captação de imigrantes qualificados ou com potencial, que permita também atrair os emigrantes portugueses ou impedir os jovens de emigrar.
"Essa é uma das mais importantes linhas de atuação do novo ACIDI: captar para reter", sublinhou.
Depois de, na década de 1990, Portugal ter atraído muita mão-de-obra, os imigrantes atuais têm hoje um perfil diferente: "têm potencial e talento, são os mais qualificados ou estão a estudar para obter as suas qualificações, são empreendedores", descreveu Pedro Lomba.
"Quando captamos imigrantes empreendedores, eles podem contribuir para reter o talento nacional", exemplificou.
O novo ACIDI, acrescentou, deve ser "um organismo para as migrações, com uma visão integrada sobre os diferentes fluxos migratórios".
O secretário de Estado salientou que o ACIDI também "tem de pensar nos seus emigrantes", desenvolvendo ações que "contribuam para a captação destes perfis migratórios, mas que também permitam o regresso dos nacionais, dos nossos cidadãos na diáspora, dos jovens qualificados, e a retenção destes jovens".
"Vivemos num contexto de competição global pelo talento, em que todos os Estados procuram criar enquadramentos para atrair essas pessoas", disse o governante, garantindo que Portugal tem muitos argumentos para convencer potenciais imigrantes: segurança, bom clima, infraestruturas de educação e de saúde e direitos reconhecidos aos imigrantes.
Pedro Lomba salientou que Portugal "tem de ter uma atitude muito mais proativa, como os outros Estado, e muito mais transversal, na captação de todos estes perfis de migrantes, tentando trabalhar nos seus próprios países de origem", nomeadamente reforçando a promoção nesses países de captação destas pessoas mais talentosas".
