1. A Comissão Europeia costuma ser o alvo privilegiado dos partidos antieuropeístas e o bode expiatório das frustrações dos governos nacionais.
Uma acusação comum à extrema-esquerda “soberanista” e à direita nacionalista é a de a Comissão “não ser eleita” e de, portanto, lhe faltar legitimidade política. Nada de mais errado. A Comissão Europeia é tão “eleita” e tem tanta ou mais legitimidade política do que os governos nacionais.
Houve tempo em que não havia eleições europeias, a Comissão era designada pelo Conselho da União e não era politicamente responsável perante ninguém. Hoje o Parlamento Europeu é diretamente eleito pelos cidadãos europeus, o presidente da Comissão é designado pelo Conselho tendo em conta os resultados eleitorais e é votado no Parlamento Europeu, a Comissão é também globalmente aprovada no Parlamento e fica submetida ao escrutínio parlamentar, podendo ser demitida por voto de censura (embora somente por uma maioria de 2/3).
No caso concreto, o atual Presidente da Comissão, Juncker, foi o nome previamente indicado pelo partido vencedor das eleições europeias de 2014 (o PPE) como candidato àquele cargo e foi eleito pelo Parlamento Europeu com uma larga maioria, mercê de um acordo político explícito com os grupos parlamentares do Partido Socialista Europeu (SD) e do Partido Liberal Europeu (ALDE).
Nestas circunstâncias, acusar a Comissão de “governo não eleito”, como meio de impugnar a sua legitimidade política, não faz nenhum sentido. Na democracia representativa de tipo federal que hoje é a UE, a Comissão não deixa muito a desejar em matéria de legitimidade democrática.
2. Outra acusação frequente, desta vez useira à esquerda, é a de que as instituições europeias, a começar pela Comissão, são inteiramente dominadas pela direita europeia representada pelo PPE. Impõem-se duas observações sobre esta acusação.
Em primeiro lugar, mesmo que fosse verdade, o único comentário a fazer seria: “É a democracia a funcionar, estúpidos”. Na verdade, se a direita ganhou as eleições europeias e governa a maioria dos estados membros da UE, como é que as instituições europeias, que decorrem desses dois pilares representativos, poderiam deixar de refletir o domínio político da direita? Se a esquerda quer inverter essa situação, trate de voltar a ser a força política dominante que já foi ao nível da UE e dos estados membros.
Em segundo lugar, o alegado domínio político e ideológico da direita na UE é moderado por vários fatores, entre os quais avultam a coligação formal ou informal entre as três forças políticas dominantes na UE (PPE, liberais e socialistas), desde logo no Parlamento Europeu, o que obriga à negociação e à concertação política e à busca de soluções de compromisso tanto quanto possível consensuais. No caso da Comissão, apesar do papel liderante do seu presidente, ela é à partida formada por uma coligação das várias famílias políticas governantes europeias, visto que os comissários são indicados pelos governos nacionais, embora em concertação com o presidente da Comissão, e sujeitos ao voto do Parlamento Europeu, que acaba por ter a última palavra, incluindo o direito de veto sobre os membros propostos para a Comissão.
Eis um poder que poucos parlamentos nacionais têm! Por isso, é infundado acusar a Comissão de ser uma coutada ideológica da direita.

The ringleader of a Rochdale child sex grooming gang cited human rights laws as he launched an appeal against deportation from Britain.
Paedophile Shabir Ahmed, 63, described by a judge as a "violent hypocritical bully", has written to the European Court of Human Rights (ECHR) claiming his convictions for child sex offences were a conspiracy to "scapegoat" Muslims, his immigration tribunal heard.
Ahmed, serving 22 years in jail, was convicted in 2012 of being the ringleader of a group of Asian men who preyed on girls as young as 13 in Rochdale, plying them with drink and drugs before they were "passed around" for sex.
He appeared before the First Tier Immigration Tribunal, sitting at Manchester Crown Court, on Tuesday to appeal against the decision by Secretary of State Theresa May to strip him of his British citizenship, the first stage in the deportation process.

Three judges will decide on Ahmed's appeal, as well as on appeals by three other men who were part of the same gang and who also face deportation.
Ahmed, who sat in the dock flanked by prison officers, told the court: "She (Theresa May) says all her trouble is coming from Muslims, yet she's the biggest trouble causer in the world."
He said he was convicted by "eleven white jurors", adding: "It's become fashionable to blame everything on Muslims these days."
Vinesh Mandalia, representing the Home Office, told the tribunal Mrs May had exercised her right as the Home Office minister to deprive Ahmed of British citizenship "if it is conducive to public good".
Mr Mandalia said Ahmed's appeal against depriving him of British citizenship included an appeal to the ECHR against his criminal convictions, which had been acknowledged by that court but did not mean they would hear his case.

Ahmed's appeal states his trial was "tainted" and a "miscarriage of justice" as it was "institutionally racist" using Muslims as "scapegoats".
Ahmed, who first came to the UK in 1967 aged 14, is a British citizen, but would not be rendered stateless as he retains Pakistani nationality having been born in Gujrat.
Three times married Ahmed told the court he had four children living in the UK, had lived here for nearly 50 years and had £83,000 in a UK bank account.
Ahmed was given a 19-year sentence at Liverpool Crown Court in May 2012 for a string of child sex offences, including rape.
He was also jailed for 22 years, to run concurrently, in July 2012 for 30 rapes against another victim.
Presiding tribunal Judge Michael Clements reserved his decision on Ahmed and the appeal of a second man, Qari Abdul Rauf.
Article 14 of the Human Rights Act says one can’t be discriminated against on the grounds of sex, race, colour, language, religion, and political opinion.
